The lawyer and founding partner of the firm has been cautious about what the end of the bankruptcy moratorium means: “there has been much talk about the fact that after the end of the so-called bankruptcy moratorium there would be an avalanche of bankruptcy proceedings. However, this perception of urgency does not seem to be perceived in a generalized way, so we will have to wait to see if that forecast is fulfilled or not. Rafael Rel has highlighted the importance of the reform to which the current Consolidated Text of the Bankruptcy Law will be subjected, which is expected to come into force during the month of September: “The reform creates a new insolvency procedure for the self-employed and micro-companies that is simplified, faster, digitized and at a lower cost, which aims to facilitate the continuity of viable companies and the reallocation of their resources.”
In his responses to Interface as an expert in Company Law, Rafael has highlighted the factors that he considers will increase the possibility of companies and freelancers becoming insolvent: “the increase in the cost of energy and raw materials, the rise in interest rates that makes the financing necessary for business activity more expensive, the increase in inflation that may result in a reduction in consumption rates, and the impossibility of fully passing on the increase in these costs in the final price of the product that companies offer their customers.”
